Privacy policies

This Privacy Policy sets out the terms under which FESANCO SpA (hereinafter, “the Company”) collects, uses, stores and protects the personal data of its customers, suppliers, collaborators and third parties, in compliance with Laws No. 19,628; 21,719 and other regulations applicable in Chile.

It is not legally mandatory to provide your personal data, but certain personal data is required to carry out or arrange a business activity with us.

Definitions

Confidential Information: According to the FESANCO Code of Conduct, “Confidential information means information or knowledge, created, acquired or controlled, that has been received orally or in writing, in a document, report, database, email, from the company, customers, suppliers, contractors, in the development of Fesanco's business under a contract with the company, which is confidential and reserved, which is considered to be protected from inadequate or unauthorized public communication, which cannot be disclosed without exceptional, express and written authorization from the employer”.

Third Parties Outside the Entity: It is that person, natural or legal, who has no relationship
direct, whether commercial or participatory, with FESANCO.

Regulatory Framework

In Chile, the law that regulates the manipulation, storage and collection of personal information is 19,628. In the future, some changes will be introduced, in terms of the approach of the Act, through Law 21,719, which comes into force on December 1, 2026.

The latter adds fundamental principles, to which FESANCO fully adheres:

- Principle of lawfulness and loyalty: Data will only be treated fairly and lawfully.
- Principle of purpose: Data will be collected for specific, explicit and lawful purposes.
- Principle of proportionality: The data being processed will be strictly limited to those that are necessary, adequate and relevant in relation to the purposes of the treatment.
- Quality principle: Data must be accurate, complete, current and relevant in relation to their origin and the purposes of treatment.
- Security principle: FESANCO is committed to keeping the data collected in a secure manner.
- Principle of transparency: FESANCO undertakes to keep access to this policy free of charge to any person, whether natural or legal, through its website.
- Principle of confidentiality: FESANCO is committed to keeping the information collected confidentially, both inside and outside the organization.
- Principle of responsibility: Those who manipulate the data are responsible for complying with each of these principles.

Taken together, all information collected from Third Parties will be equated to information protected by the FESANCO code of conduct.

Violations, in accordance with law 21.719 in its article 34, can be minor, serious or very serious; and the proportionality of the sanction will be determined by the Conduct Committee, General Management and/or the Board of Directors of FESANCO SpA. Notwithstanding the foregoing, and depending on the violation, it may be submitted to the Judiciary.

Violations are understood to be, but are not limited to, the following:

- Failure to comply with the duty of information or transparency;
- Omit responses to requested information;
- Lacking or hiding necessary means of contacts;
- Process Personal Data without the consent of the owner (s);
- Communicate or transfer Data from third parties;
- And any other violation established by law.

Responsible for data processing

The Company, with address at El Cerro El Plomo 3679, Placilla, Valparaíso, will be responsible for the processing of personal data in accordance with current regulations.

Confidential Information to Collect

The Company may collect and process the following data:

- Full Name and RUT or RUN;
- Contact Information:
Email
Telephone number
Directorate
Postal Code
- Navigation data and use of the Company's own digital systems.

Purpose of the Confidential Information Collected

FESANCO will use information from Customers and Suppliers only for commercial use and for their internal analysis.

FESANCO will use the information of third parties for the explicit purposes to which they subscribe on the various data capture platforms.

Among them are:
• Customer service and support: managing complaints, inquiries and communications.
• Marketing and communications: sending relevant information about services, events or news in the port sector, with the prior authorization of the owner.
• Financial Evaluation of potential Customers and Suppliers.

Legal basis for treatment

Data processing will be carried out in accordance with the following legal bases:
• Compliance with contractual obligations.
• Compliance with legal and regulatory regulations.
• Express consent of the data subject when required.
• The Company's legitimate interest in improving its services and security.

Data Retention

Personal data, from Third Parties outside the Entity, will be stored for a while Maximum of 10 years to fulfill the purpose for which they were collected and in accordance with applicable regulations. In addition, depending on the case, we may need to extend the retention period of your personal data for reasons of recognizing, exercising or defending legal proceedings or carrying out our internal investigations.

For any other type of personal data, they may be stored indefinitely in accordance with the judgment of The Company's employees.

Rights of the data subject

Data subjects have the following rights:

• Access: know what personal data is held.
• Rectification: correct inaccurate or incomplete data.
• Cancellation: request the deletion of data, unless there is a legal obligation to keep it.
• Opposition: Reject the use of data for certain purposes.

Security Measures

The Company implements technical and organizational measures to ensure the security of personal data, preventing unauthorized access, alteration or loss. Notwithstanding the foregoing, the Company may share your data if the judiciary so decides.

Amendments to the Privacy Policy

The Company reserves the right to modify this Privacy Policy at any time. The changes will be published in www.fesanco.cl
